Статья 100 ОБЯЗАННОСТЬ СОТРУДНИЧАТЬ В ПРЕСЕЧЕНИИ ПИРАТСТВА

Все государства сотрудничают в максимально возможной степени в пресечении пиратства в открытом море или в любом другом месте за пределами юрисдикции какого-либо государства.

Статья 101 ОПРЕДЕЛЕНИЕ ПИРАТСТВА

Пиратством является любое из перечисленных ниже действий: a) любой неправомерный акт насилия, задержания или любой грабеж, совершаемый с личными целями экипажем или пассажирами какого-либо частновладельческого судна или частновладельческого летательного аппарата и направленный: i) в открытом море против другого судна или летательного аппарата или против лиц или имущества, находящихся на их борту; ii) против какого-либо судна или летательного аппарата, лиц или имущества в месте вне юрисдикции какого бы то ни было государства; b) любой акт добровольного участия в использовании какого- либо судна или летательного аппарата, совершенный со знанием обстоятельств, в силу которых судно или летательный аппарат является пиратским судном или летательным аппаратом; с) любое деяние, являющееся подстрекательством или сознательным содействием совершению действия, предусматриваемого в подпункте a или b.

Статья 137 ПРАВОВОЙ СТАТУС РАЙОНА И ЕГО РЕСУРСОВ

1. Ни одного государство не может претендовать на суверенитет или суверенные права или осуществлять их в отношении какой бы то ни было части Района или его ресурсов, и ни одно государство, физическое или юридическое лицо не может присваивать какую бы то ни было их часть. Никакие притязания такого рода или осуществление суверенитета или суверенных прав и никакое такое присвоение не признаются. 2. Все права на ресурсы Района принадлежат всему человечеству, от имени которого действует Орган. Эти ресурсы не подлежат отчуждению. Тем не менее полезные ископаемые, добываемые в Районе, могут быть отчуждены, но лишь в соответствии с настоящей Частью и с нормами, правилами и процедурами Органа. 3. Ни одно государство, физическое или юридическое лицо не может претендовать на права на полезные ископаемые, добываемые в Районе, приобретать или осуществлять их иначе, как в соответствии с настоящей Частью. В противном случае никакие притязания такого рода на такие права, их приобретение или осуществление не признаются

Статья 140 НА БЛАГО ЧЕЛОВЕЧЕСТВА

1. Деятельность в Районе осуществляется, как это конкретно предусматривается в настоящей Части, на благо всего человечества, независимо от географического положения государств, как прибрежных, так и не имеющих выхода к морю, и с особым учетом интересов и нужд развивающихся государств и народов, которые не достигли полной независимости или иного статуса самоуправления, признанных Организацией Объединенных Наций в соответствии с резолюцией 1514 (XV) и другими соответствующими резолюциями Генеральной Ассамблеи. 2. Орган обеспечивает справедливое распределение финансовых и других экономических выгод, получаемых от деятельности в Районе, через любой соответствующий механизм на недискриминационной основе в соответствии с пунктом 2 f (i) статьи 160.

Статья 146 ОХРАНА ЧЕЛОВЕЧЕСКОЙ ЖИЗНИ

В отношении деятельности в Районе принимаются необходимые меры в целях обеспечения эффективной охраны человеческой жизни. С этой целью Орган принимает соответствующие нормы, правила и процедуры в дополнение к существующему международному праву, как оно воплощено в соответствующих договорах.

Article 8 The United Nations shall place no restrictions on the eligibility of men and women to participate in any capacity and under conditions of equality in its principal and subsidiary organs.

Article 100. Obligation to cooperate in the suppression of piracy

All states cooperate as much as possible in the suppression of piracy on the high seas or in any other place outside the jurisdiction of any state.

Section 101. Definition of Piracy

Definition of Piracy

Piracy is any of the following:

a) any unlawful act of violence, detention or any robbery committed for personal purposes by the crew or passengers of a private-owned vessel or private-owned aircraft and directed:

i) on the high seas against another ship or aircraft or against persons or property on board;

ii) against any ship or aircraft, persons or property in a place outside the jurisdiction of any state;

b) any act of voluntary participation in the use of any ship or aircraft, committed with knowledge of the circumstances by which the ship or aircraft is a pirate ship or aircraft;

c) any act that constitutes incitement or knowingly contributes to the commission of an act provided for in subparagraph "a" or "b".

Article 137. Legal status of the Area and its resources.

1. No State may claim or exercise sovereignty or sovereign rights in respect of any part of the Area or its resources, and no state, individual or legal entity may appropriate any part thereof. No claim of this kind or exercise of sovereignty or sovereign rights and no such appropriation shall be recognized.

2. All rights to the resources of the Area belong to all of humanity, on whose behalf the Authority acts. These resources are not subject to alienation. However, minerals mined in the Area may be alienated, but only in accordance with this Part and with the norms, rules and procedures of the Authority.

3. No state, individual or legal entity may claim the rights to minerals mined in the Area, acquire or exercise them otherwise than in accordance with this Part. Otherwise, no claims of this kind on such rights, their acquisition or exercise are recognized.

Article 140. For the benefit of humanity

1. Activities in the Area are carried out, as specifically provided for in this Part, for the benefit of all mankind, regardless of the geographical position of states, both coastal and landlocked, and with particular regard to the interests and needs of developing states and peoples that did not achieve full independence or other self-government status recognized by the United Nations in accordance with resolution 1514 (XV) and other relevant General Assembly resolutions.

2. The Authority shall ensure the equitable distribution of financial and other economic benefits arising from activities in the Area through any appropriate mechanism on a non-discriminatory basis in accordance with paragraph 2 “f” (i) of Article 160.

Article 146. Protection of Human Life

With respect to activities in the Area, the necessary measures are being taken to ensure the effective protection of human life. To this end, the Authority adopts relevant norms, rules and procedures in addition to existing international law, as embodied in the relevant treaties.
